Key Booking, Payment and Cancellation Rules

Customer summary — read the complete terms below before booking

1. Booking Terms & Conditions

Website-ready customer contract for all trips sold or operated by Barunche.

1.1 About These Terms

These Booking Terms and Conditions govern every booking made with Barunche Treks & Expedition Pvt. Ltd. (“Barunche”, “we”, “us” or “our”), a travel and adventure operator based in Balaju-16, Kathmandu, Nepal. They apply to trekking, hiking, cultural tours, wildlife tours, helicopter services, peak climbing, mountaineering expeditions and other travel services arranged by us.

The person making a booking (the “Lead Booker”) confirms that they have authority to accept these terms for every traveller named in the booking. The Lead Booker must provide each traveller with these terms and all trip information. A contract is formed only when we receive the required payment and issue written booking confirmation.

1.2 Contract Documents and Order of Priority

Your contract consists of our written booking confirmation, final trip proposal or invoice, the trip itinerary and inclusions, these Booking Terms, and any trip-specific conditions disclosed before booking. If documents conflict, trip-specific written conditions and the booking confirmation take priority, followed by these Terms. Website descriptions and sample itineraries are informative until incorporated into a written confirmation.

If a booking is made through an authorized travel agent, the agent acts for the traveller when submitting information, accepting documents and making or receiving booking communications. The traveller remains responsible for ensuring that Barunche receives accurate details and payment by the applicable deadlines. Any separate agreement between the traveller and the agent does not change Barunche’s obligations unless Barunche agrees in writing.

1.3 Eligibility, Age and Authority

1.4 Prices and What Is Included

The price and currency shown in the booking confirmation apply to your booking. Only services specifically listed as included are included. International flights, visas, insurance, vaccinations, personal equipment, tips, personal expenses, extra accommodation, rescue costs and services caused by disruption are excluded unless expressly stated otherwise. An optional activity arranged directly between a traveller and an independent provider is outside the Barunche booking contract unless Barunche expressly includes and confirms that activity in writing.

Prices may be quoted per person based on group size, room sharing, route, season and supplier availability. If the confirmed group size later decreases because one or more travellers cancel or transfer, the price for the remaining travellers may be recalculated only where the original price was expressly based on that group size. We will explain any change before requiring payment. A single supplement does not guarantee a single room in remote areas where inventory is limited.

1.5 Deposit and Booking Confirmation

A standard deposit equal to 30% of the total confirmed trip price is required to request a booking. The deposit is applied toward the trip price and is subject to the cancellation rules in Section 2. A higher, staged or partly non-refundable deposit may apply to mountaineering expeditions, peak climbing, Tibet or Bhutan travel, restricted-area permits, charter flights, luxury accommodation, large private groups or any service requiring substantial advance supplier payment. Before accepting payment, we will state the amount, due date and any special non-refundable component in the trip proposal or invoice.

A payment receipt, transfer confirmation or automated acknowledgement confirms only that payment information has been received; it does not confirm trip availability. A binding booking is formed only after cleared funds reach Barunche and we issue written booking confirmation identifying the traveller, trip, departure date, price and payment status. If we cannot confirm the requested arrangements, we will offer a suitable alternative or return the amount received for the unconfirmed service.

1.6 Final Payment

The remaining balance must be received in cleared funds no later than 30 calendar days before the scheduled departure date. A booking requested within 30 days of departure requires full payment at the time of booking. The invoice or booking confirmation will show the amount paid, balance due, currency and due date. If the balance is not received on time, we will contact the Lead Booker and may suspend arrangements or treat the booking as cancelled by the traveller. Applicable cancellation charges and unrecoverable supplier costs may then be deducted.

1.7 Payment Methods, Currency and Charges

1.8 Price Changes After Booking

We will not change a confirmed price merely because our general website price later changes. However, before full payment we may pass on a documented increase caused by government taxes, permit or park fees, mandatory aviation charges, exchange-control measures or other compulsory charges introduced after booking. We will notify the Lead Booker in writing and explain the reason, amount and supporting basis. If the increase is material, the traveller will have at least seven calendar days from notice to accept the revised price or cancel. Any refund will comprise recoverable payments less non-refundable costs already committed with the traveller’s prior knowledge, unless applicable law requires otherwise.

1.9 Traveller Information

Each traveller must provide accurate and timely information requested for permits, tickets, accommodation, safety and emergency planning, including their legal name, date of birth, nationality, passport details, emergency contact, dietary needs, relevant medical information and insurance details. A traveller who requires mobility support, accessible accommodation, communication assistance or another reasonable adjustment should tell us before booking so we can assess what is practicable on the proposed route. We cannot guarantee an adjustment that is unavailable, unsafe or incompatible with permit, supplier or remote-area conditions, but we will explain material limitations before confirmation. Costs and losses caused by late, incomplete or inaccurate information remain the traveller’s responsibility.

1.10 Passports, Visas, Permits and Entry Rules

Travellers are responsible for holding a valid passport, visas, entry permits, re-entry permissions, vaccination evidence and other documents required for Nepal and any transit or destination country. We may assist with arrangements, but immigration and government authorities make final decisions. Refusal, delay or removal by an authority does not entitle a traveller to a refund of services we can no longer recover.

1.11 Health, Fitness and Medical Disclosure

Adventure travel can involve altitude, isolation, rough terrain, severe weather and limited medical facilities. Travellers must assess their suitability, obtain medical advice where appropriate and disclose any condition, medication, allergy, disability or recent illness that could reasonably affect safe participation or emergency treatment. Information will be handled in accordance with our Privacy Policy and shared only where reasonably necessary for safety and service delivery.

1.12 Travel Insurance

Comprehensive travel insurance is mandatory for trekking, climbing and expedition trips and strongly recommended for all other trips. The policy must cover the booked activity, maximum planned altitude, emergency medical treatment, helicopter or other evacuation where relevant, search and rescue, repatriation, trip cancellation, interruption and personal liability. Travellers must provide evidence of adequate cover when requested. Insurance arranged or suggested by a third party remains the traveller’s responsibility.

1.13 Itineraries and Adventure Travel Flexibility

Published itineraries are plans, not guarantees. Routes, timings, transport, accommodation, camps, activities and sequence may change because of weather, trail or road conditions, flight disruption, health, safety, permit restrictions, local events, government action, supplier failure or other operational reasons. Our team will use reasonable care to provide a suitable alternative where practicable, but the traveller must accept reasonable flexibility inherent in Himalayan and remote-area travel.

1.14 Guide and Expedition Leader Authority

For safety and operational decisions during a trip, travellers must follow the lawful and reasonable directions of the guide, trip leader, climbing leader or expedition leader. The leader may change the route, require rest or descent, stop an activity, refuse a summit attempt, separate a participant from the group, or arrange evacuation where reasonably considered necessary. Summit success is never guaranteed.

1.15 Traveller Conduct

Travellers must respect local laws, customs, religious sites, communities, wildlife, staff and other guests. Harassment, discrimination, violence, illegal drugs, dangerous intoxication, deliberate environmental harm, abuse of staff, reckless conduct or repeated refusal to follow safety instructions may result in removal without refund. The traveller is responsible for resulting loss, damage, transport or accommodation costs.

1.16 Accommodation, Transport and Flights

Remote accommodation, roads and aviation operate to local conditions and may differ from expectations in a traveller’s home country. Mountain flights and helicopter services are weather-dependent and subject to operator and aviation-authority decisions. Delays, diversions, baggage limits and cancellations may occur. Travellers should allow reasonable contingency time between a remote-area or mountain flight and any separately booked international departure. Unless caused by our failure to use reasonable care, additional meals, accommodation, transport or rebooking costs are payable by the traveller and should be claimed from insurance where covered.

1.17 Changes Requested by the Traveller

Requests to change names, dates, routes or services must be made in writing. Changes are subject to availability, operational feasibility and supplier rules. The traveller must pay any price difference, administration charge and non-refundable supplier cost. A material change may be treated as a cancellation and new booking.

1.18 Transfer of a Booking

A traveller may ask to transfer a booking to another eligible person. We may approve the transfer where permits, tickets, suppliers and safety requirements allow it. The request must be made early enough to complete the change, and both travellers are responsible for all change fees, price differences and non-refundable costs. Certain permits, air tickets and expedition registrations cannot be transferred.

1.19 Cancellation by the Traveller

Cancellation must be submitted in writing by the Lead Booker to barunche.treks1@gmail.com or through another written channel expressly approved by Barunche. It takes effect at the date and time the notice reaches the approved channel; our acknowledgement is evidence of receipt but is not required for the cancellation to take effect. Charges are calculated on the total trip price under the Cancellation, Amendment & Refund Policy. We strongly recommend insurance that covers cancellation for qualifying events.

1.20 Cancellation or Material Change by Barunche

We may cancel or materially change a trip where necessary for safety, insufficient participation, supplier failure, permit refusal, government restriction or circumstances beyond reasonable control. If a trip requires a minimum group size, that requirement and the latest date for notifying travellers of cancellation will be disclosed before booking. Where we cancel before departure for a reason within our control, the traveller may choose an available comparable alternative, a credit or a refund of amounts paid for the affected trip. Unless required by law, we are not responsible for separate or consequential expenses such as international flights, visas, insurance, vaccinations, equipment or lost earnings.

1.21 Events Outside Our Control (Force Majeure)

Force majeure means an event beyond the reasonable control of the affected party, including severe weather, avalanche, earthquake, flood, fire, epidemic or pandemic, war, terrorism, civil unrest, border closure, government action, airspace closure, labour disruption, transport interruption, natural disaster or comparable event. We may suspend, reroute, postpone or cancel affected services. Refunds or credits will be limited to money actually recovered from suppliers after deducting services already provided and reasonable, non-recoverable costs, subject to applicable law.

1.22 Emergency Assistance and Evacuation

In an emergency, we may arrange medical care, evacuation, rescue, transport or communication that we reasonably believe is necessary when the traveller cannot give instructions or delay could create danger. The traveller authorizes us to contact insurers, emergency contacts, medical providers and rescue operators. All rescue, evacuation and medical costs remain the traveller’s responsibility unless expressly included or paid by insurance.

1.23 Unused Services and Early Departure

No refund is normally available for services voluntarily missed, late arrival, early departure, failure to meet entry or fitness requirements, or removal for conduct or safety reasons. If we recover a material unused supplier amount, we may return it after deducting reasonable administration and non-recoverable costs, but we do not guarantee recovery.

1.24 Baggage and Personal Property

Travellers are responsible for their baggage, valuables, documents and equipment. Porters, airlines, hotels and transport providers may apply weight limits and separate liability rules. Any equipment supplied or rented through Barunche must be used with reasonable care and returned at the agreed time; the traveller may be charged the reasonable repair or replacement cost for loss or damage beyond ordinary wear, subject to the rental terms disclosed before use. We are responsible only to the extent loss is directly caused by our failure to use reasonable care and liability cannot lawfully be excluded or limited.

1.25 Independent Suppliers

We arrange services from airlines, hotels, lodges, transport companies, helicopter operators, guides, porters and other independent suppliers. Their own conditions may apply. We remain responsible for our own duties under the booking contract and applicable law, but are not responsible for an independent supplier’s act or omission where we selected and coordinated that supplier with reasonable care and the event was outside our control.

1.26 Complaints

A concern should be reported promptly to the guide or Barunche representative so we have a reasonable opportunity to address it during the trip. If it remains unresolved, submit a written complaint to barunche.treks1@gmail.com with the booking reference, relevant dates, a clear description and supporting documents. Complaints should normally be submitted within 30 days after the trip ends. We aim to acknowledge a formal complaint within five business days and provide a substantive response within 30 business days, or explain why more time is reasonably required. Delay does not remove rights that cannot legally be waived, but may make investigation or remedy more difficult.

1.27 Liability

Barunche will perform its contractual services with reasonable care and skill. Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability arising from fraud, wilful misconduct or any other non-excludable obligation under applicable law. Subject to those rights, we are not liable for loss caused by a traveller’s act, an unrelated third party, an unavoidable event, or inherent risks properly disclosed and accepted by the traveller.

To the maximum extent permitted by law, liability for a claim arising from the booking is limited to the amount paid to Barunche for the affected traveller and trip, except where a different limit is required by law or where applying the limit would be unlawful or manifestly inappropriate. We do not exclude responsibility for our own negligence where the law does not permit it.

1.28 Governing Law and Disputes

The parties should first attempt to resolve a dispute in good faith through written negotiation. Unless mandatory consumer law provides otherwise, the booking contract is governed by the laws of Nepal and disputes are subject to the competent courts of Kathmandu, Nepal. A traveller may also use any statutory complaint or consumer remedy available under applicable law.

1.29 Changes to These Terms

The version accepted when the booking is confirmed governs that booking. We may update website terms for future bookings, but will not retrospectively replace confirmed contractual rights without agreement or a lawful reason.

If any provision is found unlawful or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue to apply. A delay or failure by either party to enforce a right does not waive that right. No employee, guide or supplier may vary these Terms unless the change is confirmed in writing by an authorized Barunche representative.

2. Cancellation, Amendment & Refund Policy

Clear commercial rules for cancellations, postponements, date changes and refunds.

2.1 General Rule

Only the Lead Booker may cancel a booking. The request must be sent in writing to barunche.treks1@gmail.com or through another written channel expressly approved by Barunche. The effective cancellation date and time are when the notice reaches that approved channel; Barunche’s acknowledgement is evidence of receipt but is not required for the cancellation to take effect. We will provide a written cancellation calculation. Charges reflect planning, administration, permits, staff allocation and supplier commitments and are calculated as a percentage of the total confirmed trip price—not merely the amount already paid. If the amount paid is less than the applicable charge, the outstanding difference remains payable; if it is more, the refundable balance will be calculated under this policy.

2.2 Standard Cancellation Charges

Written notice before departure — Cancellation charge

More than 60 days — 30% of total trip price (normally the booking deposit)

31–60 days — 50% of total trip price

15–30 days — 75% of total trip price

14 days or fewer — 100% of total trip price

No-show or cancellation after departure — 100% of total trip price

If the non-refundable costs already committed for a booking exceed the standard charge, the higher actual cost may apply only where this possibility and the relevant special conditions were disclosed before booking. If mandatory law requires a lower charge or refund, that law prevails.

2.3 Expeditions, Peak Climbing and Special Services

Mountaineering expeditions, peak climbing, restricted-area permits, Tibet or Bhutan arrangements, charter flights, helicopter charters, luxury properties, festival departures and large private groups may have stricter or earlier non-refundable commitments. A trip-specific payment and cancellation schedule will be stated in the proposal or booking confirmation and takes priority over the standard schedule.

2.4 Date Changes and Postponement

A request to postpone or change departure date must be made in writing. When received more than 45 days before departure, we may allow one transfer to a new date within 12 months, subject to availability, season, permit rules and supplier approval. Any non-refundable loss, price increase, change fee or new permit cost is payable by the traveller. Credits are personal, non-transferable and have no cash value unless we agree otherwise in writing.

2.5 Name and Participant Changes

Participant changes are allowed only when suppliers, permits, tickets and safety requirements permit. Non-transferable permits and tickets may need to be purchased again. The substitute traveller must meet all trip requirements and accept the applicable terms.

2.6 Cancellation by Barunche Before Departure

If Barunche cancels a trip before departure for a reason within our reasonable control, the traveller may choose an available comparable trip, a credit, or a refund of payments received for the cancelled trip. This does not include separate costs such as international airfare, visa fees or equipment, so travellers should book flexible arrangements and maintain insurance.

2.7 Events Outside Our Control, Government Restrictions and Safety

If a trip is prevented or materially affected by unavoidable circumstances, we may offer a revised itinerary, postponement or credit. Any cash refund will be based on funds actually recovered from suppliers, less services already provided and reasonable non-recoverable costs. We will provide a reasonable explanation of the calculation when requested. Statutory refund rights, where applicable, are unaffected.

2.8 Trip Interruption, Missed Services and Early Return

No refund is normally due for late arrival, missed transport, voluntary withdrawal, unused services, early return, lack of travel documents, failure to disclose a relevant condition, failure to follow safety directions or removal for misconduct. Additional arrangements are charged to the traveller. We will reasonably assist with insurance documentation.

2.9 Refund Method and Timing

After confirming an approved refund in writing, Barunche will normally return it to the original payer using the original payment method where feasible. We will provide a calculation showing the trip price, applicable cancellation charge, non-recoverable supplier costs where permitted, payments received and refundable balance. Processing begins after supplier reconciliation and may take up to 30 business days. Non-recoverable bank, intermediary, card, foreign-exchange and payment-provider fees may be deducted. The receiving bank or payment provider may require additional processing time.

2.10 Chargebacks

A traveller should contact Barunche first about an unrecognized or disputed charge. Initiating a chargeback does not cancel the booking or override these terms. We may provide the booking record, accepted terms, invoices and service evidence to the payment provider. This clause does not restrict a lawful right to dispute an unauthorized or incorrectly processed payment.

3. Adventure Risk, Health, Insurance & Emergency Policy

Safety-focused disclosures and traveller responsibilities for remote and high-altitude travel.

3.1 Acknowledgement of Adventure Risk

Trekking, climbing, mountaineering, wildlife travel, helicopter travel and journeys in remote regions involve risks that cannot be completely eliminated. These may include altitude illness, falls, rockfall, avalanche, landslide, flood, severe weather, cold or heat injury, road accident, aviation disruption, illness, infection, food or water issues, wildlife, political events, limited communications and delayed medical care.

By booking, the traveller acknowledges the general nature of these risks and agrees to follow the trip information, equipment requirements and safety directions. Acceptance of inherent risk does not excuse Barunche from duties that cannot lawfully be excluded.

3.2 Medical Fitness and Disclosure

3.3 Altitude

Any traveller can develop altitude illness regardless of age or fitness. Symptoms must be reported immediately and honestly. The guide may require rest, stop ascent, administer available emergency measures, arrange descent or evacuation. A traveller who refuses a safety instruction may be removed from the trip and is responsible for resulting costs.

3.4 Mandatory Insurance Standard

For trekking, climbing and expeditions, insurance must cover the specific activity and maximum altitude shown in the itinerary, emergency medical treatment, evacuation by helicopter or other means where available, search and rescue, repatriation, cancellation and interruption. Policies that exclude mountaineering, use of ropes or crampons, off-trail travel, remote areas or altitude above a stated limit may be inadequate. The traveller must confirm coverage directly with the insurer.

3.5 Emergency Authorization

If urgent action is reasonably needed, the traveller authorizes Barunche and its representatives to contact emergency services, insurers and emergency contacts and to arrange evacuation, rescue, transport or medical treatment. Barunche cannot guarantee helicopter availability, weather clearance, insurer pre-authorization, response time or medical outcome.

3.6 Emergency Costs

The traveller is responsible for all medical, evacuation, rescue, accommodation, transport and repatriation costs. Where a supplier requires a guarantee or immediate payment, the traveller may need to pay directly or authorize payment. Barunche may seek confirmation from an insurer but is not required to advance personal emergency costs.

3.7 Safety Decisions and Summit Attempts

The guide or expedition leader has final operational authority over ascent, descent, route, turnaround time, rope use, weather decisions and a traveller’s continued participation. Mountain or summit success is never guaranteed, and no refund is due when an attempt is stopped for reasonable safety, health, weather or operational reasons.

3.8 Personal Responsibility

3.9 Separate Declaration

For higher-risk trips, Barunche may require a signed medical questionnaire, informed-risk acknowledgement or supplier waiver. Any such document supplements these terms and does not remove rights or responsibilities that cannot lawfully be waived.

4. Privacy Policy

Explains how Barunche collects, uses, shares and protects personal information.

4.1 Who We Are

Barunche Treks & Expedition Pvt. Ltd., Balaju-16, Kathmandu, Nepal, is responsible for personal information collected through our website, enquiries, bookings and trip operations. Privacy questions may be sent to barunche.treks1@gmail.com.

These recipients may act under their own legal and privacy responsibilities.

4.7 International Transfers

Travel necessarily requires information to be used in Nepal and sometimes in other destination or transit countries. Technology and payment providers may also process information internationally. Privacy protections may differ between countries. We limit transfers to what is reasonably needed and use contractual, consent-based or other appropriate safeguards where available.

4.8 Retention

We retain information only as long as reasonably necessary for bookings, safety, accounting, tax, insurance, disputes, legal compliance and legitimate business records. Enquiry records may normally be kept for up to 24 months after last contact. Booking and financial records are retained for the period required by applicable law. Health details are restricted to the operational, emergency and claims period unless longer retention is legally necessary.

4.9 Security

We use reasonable administrative, technical and physical safeguards, including access controls, staff confidentiality, secure service providers, backups and restricted sharing. No internet or storage system is completely secure. Travellers should use trusted channels and avoid sending unnecessary passports or medical data through public messages. If a security incident creates a material risk to personal information, we will investigate, take reasonable containment and remediation steps, keep an incident record, and notify affected persons or authorities where applicable law requires it.

4.10 Marketing Choices

Marketing email or messages will be sent only in accordance with applicable law and consent requirements. Consent is separate from booking and may be withdrawn at any time using the unsubscribe method or by contacting us. Service messages about an active enquiry or booking are not marketing.

4.11 Cookies and Analytics

Our website may use essential, preference, analytics and advertising cookies as described in the Cookie Policy. Non-essential cookies should not be activated until the user has made the required choice where consent is required.

4.12 Privacy Requests

Subject to applicable law, a person may ask to access or correct their information, withdraw consent, object to certain use, request deletion where retention is not required, or complain about handling. Requests should be sent to barunche.treks1@gmail.com with enough information to identify the person and the request. We may need to verify identity and may retain information where law, safety, accounting or legal claims require it.

4.13 Children

We do not knowingly collect a child’s information for independent booking. A parent or guardian must provide or authorize information needed for a minor traveller. Marketing should not be directed to children.
